Terms & Policies

Thank you for choosing Kailey Tucker Photography. These Terms & Policies are designed to protect both the client and the photographer and to ensure a smooth, respectful, and enjoyable experience. By booking a session, submitting a booking form, or making a payment, you agree to the following terms.

Booking & Availability

All sessions are booked on a first-come, first-served basis and are not secured until a retainer is paid and required forms are completed. Availability is limited and dates are not held without payment.

Consultation Policy

A free consultation is required for all sessions.

• Consultations should be completed prior to booking, or scheduled the same day the session is booked, for the client’s earliest convenience. • The consultation allows us to review vision, expectations, styling, logistics, and any special considerations. • If a consultation is not booked or completed within 48 hours of booking, the appointment will be canceled and the retainer will be refunded.

This policy exists to prevent miscommunication and ensure every session is fully prepared.

Payment & Retainer

• A retainer may be required to reserve your session date and time. • Retainers secure the date and time only and are non-refundable after the consultation window has closed. • The remaining balance is due on or before the session date, unless otherwise agreed in writing. • The individual booking the session and signing the agreement must be 18 years or older and is financially responsible for all charges.

Cancellations, Rescheduling & No-Shows

• Cancellations must be made with reasonable notice. • Retainers are non-refundable but may be transferable to a new date at the photographer’s discretion. • Rescheduling is subject to availability and may incur a rescheduling fee if requested with limited notice. • Failure to arrive for a session without notice may result in forfeiture of all payments made.

 

Late Arrival Policy

Session start times are firm.

• Clients may arrange to arrive up to 30 minutes early for changing or preparation. • Arriving late will reduce shooting time. • Sessions will end at the scheduled time, regardless of late arrival. • Time will not be extended to accommodate delays caused by traffic, parking, outfit changes, or arriving unprepared.

 

Overtime

Additional shooting time is not guaranteed and must be approved by the photographer. If approved, overtime will be billed at the current rate.

 

Illness & Safety

• Please notify the photographer as soon as possible if you or a child is ill. • The photographer reserves the right to reschedule or refuse to photograph visibly ill clients for health and safety reasons.

 

Artistic Style & Editing

• Images are edited in the photographer’s portfolio style. • Requests to replicate another photographer’s work will not be honored. • Extensive retouching, revisions, or creative

changes may incur additional fees. • Unedited RAW files are not delivered.

 

Image Delivery

• Final images are delivered via an online gallery. • Image counts vary by session type and subject cooperation; minimums apply based on the selected package. • Delivery timelines will be discussed during the consultation and may vary by season or workload.

 

Interference & Cooperation

Kailey Tucker Photography is not responsible for missed images due to uncooperative subjects, distractions, environmental conditions, or interference from other cameras or individuals.

 

Minors

• Any client under 18 must be accompanied by a parent or legal guardian. • Age-appropriate clothing is required. • Lingerie, overly revealing, or suggestive attire is not permitted for minors.

 

Copyright & Usage Rights

• Kailey Tucker Photography retains full copyright to all images. • Clients receive a non-exclusive license for personal use. • Images may not be cropped, edited, filtered, or altered. • Commercial use, sale, or publication requires written permission. • Clients are responsible for ensuring friends, family, and vendors do not alter images.

 

Model Release

Unless otherwise stated in writing prior to the session, the client grants permission for images to be used for portfolio, website, social media, and marketing purposes.

 

Liability & Assumption of Risk

Clients assume all risks associated with the session. Kailey Tucker Photography is not responsible for injuries, damages, or loss incurred during the session, including but not limited to interactions with props, equipment, locations, or other participants. Parents and guardians are responsible for the safety and behavior of minors.

Force Majeure

Kailey Tucker Photography shall not be held liable for events beyond reasonable control, including but not limited to weather, illness, natural disasters, power outages, or emergencies. In such cases, sessions may be rescheduled at the photographer’s discretion.

Privacy

Personal information collected is used solely for communication and service fulfillment and will not be shared or sold.

Agreement

By booking a session, submitting a booking form, or making payment, the client acknowledges that they have read, understood, and agreed to these Terms & Policies.
