Wedding Photography Agreement — Effective Upon Payment

This page outlines the full terms and conditions of service between Kailey Tucker Photography and the client (“you”) for wedding photography services.
By submitting payment for any portion of your wedding invoice, you acknowledge that you have read, understood, and agreed to these terms. Your payment constitutes a legally binding agreement. No signature is required.
📝 Full Contract Terms
1. RETAINER

To secure your wedding date, a 25% non-refundable retainer is required. Your retainer ensures that Kailey Tucker Photography reserves your event date exclusively for you and does not accept other bookings that day.

Because the date is held in good faith and time is blocked off in advance, the retainer is non-refundable under all circumstances, unless the photographer cancels or is unable to perform the services.
Before submitting payment, clients are strongly advised to confirm their venue and timeline.
2. CANCELLATION & RESCHEDULING

If you need to reschedule your wedding after booking, a 25% rescheduling fee (based on your total package price) will be charged. This is due to the lost income from holding your original date and adjusting future bookings to accommodate the change.
3. BALANCE

The remaining balance of your photography package is due no later than one week (7 Business Days) prior to event date. Payment plans are available upon request. Please ensure all details (venue, timing, etc.) are finalized before paying your deposit.
4. COPYRIGHT & USAGE

Kailey Tucker Photography retains full copyright ownership of all images delivered under this contract.

You are granted personal-use rights, including printing and sharing with family or friends. However:

You may not sell, alter, or commercially use the images without written permission.

If posting online (Instagram, Facebook, etc.), images must be shared as delivered. Credit to the photographer is preferred but not required.

Clients are responsible for ensuring that friends and family do not crop, filter, or otherwise edit the images when posting online.
If changes or edits are desired by the client, please notify your photographer. This is to avoid any loss of quality to the product and to maintain the photographer’s intended style and representation of her work.
5. ARTISTIC RIGHTS

You trust Kailey Tucker Photography to use creative judgment during shooting and editing.

Final edits reflect the artist’s style and discretion. Minor retouching is included; extensive edits may incur a fee.

All final images will be professionally edited in Kailey’s signature style. This includes color correction, exposure, and light retouching.

Additional retouching (beyond the standard editing process)—such as slimming, head swaps, or removal of permanent features—can be requested at a rate of $10 per image.
6. IMAGE DELIVERY, STORAGE, & BACKUP

Your online gallery will be delivered within 4–6 weeks of your wedding date.

After receiving your images, clients are responsible for downloading and backing them up in at least three locations. Physical prints are highly encouraged for long-term safekeeping.

While your photographer retains master backups for up to 6 months, there is no guaranteed retrieval of lost files after delivery.
7. LIABILITY
Interference
Kailey cannot be held responsible for missed moments due to interference from guests (e.g., blocking shots with phones, stepping into aisles, or ignoring photo direction).
Breaks
As per Tennessee labor law, the photographer is entitled to a 30-minute break every 6 hours and short restroom breaks as needed.
Weather
Photographers cannot shoot in weather conditions that risk damage to equipment. For outdoor events, please have an indoor or covered backup plan. Reduced coverage due to weather will not result in refunds.
Venue Restrictions
It is your responsibility to communicate any venue restrictions (no flash, limited access, etc.) to the photographer in advance. These limitations may impact the final result.
Damage to Equipment
If any guest or member of the wedding party damages the photographer’s equipment, the client(s) are responsible for covering repair or replacement costs within 7 days of the event.
DJ & Venue Lighting
Strong DJ lights (deep purples, greens) can distort skin tones and affect image quality. We recommend soft yellows, blush pinks, light blue/green tones instead.
If your venue dims the lights during key moments (first dance, toasts, etc.), please understand that image quality depends on the available light unless flash is permitted.
8. OVERTIME & ADDITIONAL SERVICES

Additional hours may be available at $100/hr.

All add-ons must be agreed upon in writing before or on the event day.
9. CANCELLATION BY PHOTOGRAPHER
If Kailey is unable to photograph your wedding due to illness, injury, or emergency, she will:

Provide a qualified professional replacement, OR
-
Offer a full refund of any amounts paid, including the retainer.

Kailey maintains a strong professional network and will make every effort to ensure seamless coverage.
10. ACCEPTANCE OF TERMS
By paying your deposit, you confirm that you have read, understood, and agreed to all terms listed above. This digital agreement is legally binding and applies in full once payment is submitted.
